BUREAUCRATS REFUSE TO LISTEN - INCLUDE CHILDREN'S SNOWMOBILES IN BAN

Dear BRC Action Alert Subscriber,

Despite calls for Congressional hearings (http://www.sharetrails.org/alerts/?alert=951) the Consumer Product Safety Commission (CPSC) is refusing to lift the ban on children's off highway vehicles.

CPSC Commissioners voted late last week on procedures for determining exclusions. Based on that vote, BRC is not optimistic that the exclusion for youth model ATVs and dirt bikes will be granted anytime soon. Indeed, the bureaucrats at the CPSC have emphasized that their ban includes children's snowmobiles!

If you have already sent a letter to Congress and the CPSC, we want to thank you. Thanks to your many letters, phone calls, protests, and emails, the media has been reporting the obvious - that kids don't eat their ATVs and motorcycles!

The BlueRibbon Coalition is asking its members to redouble their efforts to fight the ban on youth OHVs. We are asking that folks follow up with another letter or email. We are also asking our members to forward this information to their friends and family.

The potential losses for the industry and local dealers are massive - up to $1 billion in retail economic value annually.

BRC asks you to join the efforts of the Western Caucus, Congressman Mike Simpson, Congressman Duncan Hunter, State Senator Tom Self, MIC/SVIA, and others to "encourage" the CPSC to do the right thing and grant existing petitions for a stay.

This is actually a hot topic. It will make machines like our 120's illegal. We should make an effort to get our Congressional deligation working for us on this one. I'll draft something up and get it posted soon.

I discussed this issue with Craig Hill at Northern Power Sports. He said the manufacture is taking steps to assure the 120 machines are available. Apparently the paint on the engine has lead in it and the Gov't types think the kids are going to eat the engine. Things being looked at are bolting down cowlings so kids cannot gain access to the engine. Stickering up the machine with warning labels about lead in paint. Guess the kids can read and understand warning labels about paint.

Also I reviewed the manufactures models for 2010 and there is NO fan cooled engines below a 550cc listed on their web sites. Craig Hill says they are still going to get the Bravo out of Canada for now. That will make it the only single cylinder machine left on the market for kids and there will be no 340/440 class machines or what we can call midsize for our younger and beginning riders. The fan cooled machines were eliminated by the Fed air quality standards.

Got to love that Government.

Here is my post to our Congressional Deligation:

Like many Alaskans, I am a snowmachiner. I am very concerned about the Consumer Product Safety Commission's (CPSC) recent approval of a final rule imposing strict standards for excluding products from the new lead content limits of the Consumer Product Safety Improvement Act (CPSIA). The final rule makes clear that CPSC will not provide relief for youth model snowmobiles. They will be banned. While it is true that there are lead parts in the engines of snowmobiles, children do not disassemble the engines or eat the engine’s parts. If the CPSC remains unreasonable, the Congress needs to step in and make immediate technical amendments to Section 101(b) of the CPSIA to ensure that reasonable exclusions can be made for youth model snowmobiles. This is an important issue for a lot of Alaskans.
